Tag: Pecuniary damages

For a personal injury claim, there are two main parts to a settlement from the insurance company: pecuniary damages and non-pecuniary damages.  Pecuniary damages are also known as economic or special damages. Non-pecuniary damages are known as general damages. Pecuniary damages refer to financial losses that can be calculated with a specific monetary value. These are losses that can be proven with documentation like bills, receipts, or pay stubs. Examples include medical expenses, lost wages, and property damage.  Pecuniary damages are quantifiable compensatory damages. They can be measured in financial terms and are usually easier to calculate. Your personal injury lawyer will fight to maximize both pecuniary damages and non-pecuniary damages recovered in your injury claim settlement.

Examples of pecuniary damages include:

Past and future loss of income. This often include a prediction of potential future earnings lost as a result of the injury.
Past and future housekeeping and home maintenance expenses.
Future care costs.
Medical and rehabilitation costs, since the injury and into the future.
Travel expenses like taxi, Uber, Lyft. These require receipts and documentation. The pecuniary damages may include a predictive estimate of future travel expenses for your claim.
