Tag: non-pecuniary damages

Non-pecuniary damages generally include pain and suffering and loss of amenity and mental distress.  The non-pecuniary damages are a large part of your personal injury claim.  And the most difficult to quantify.  Your personal injury lawyer will use their expertise to determine how much your pain and suffering (non-pecuniary losses) are worth as a part of your claim.  Non-pecuniary damages are also referred to as general damages.  The non-pecuniary compensation is awarded in legal cases for losses that are not easily quantifiable in monetary terms, such as pain and suffering, emotional distress, and loss of enjoyment of life. These are the intangible harms experienced by the injured party.

By contrast, the pecuniary damages are quantifiable financial losses like lost wages, medical expenses, and damage to the vehicle or property.

A personal injury claim will include both pecuniary damages and non-pecuniary damages as part of the final settlement from the insurance company.
